When parents of a child are divorced in Texas, or were never married to each other, the court will issue orders as
to who (almost always one of the parents) will have the right to determine where the child will live, and when, if
at all, the other parent has custody of or visitation with the child. This is one of the two most disputed areas
in a divorce involving minor children (the other, of course, is child support).
Arguments about custody and visitation can generate very heated emotions, and the child, if exposed to these
disagreements, can feel torn between loyalties to the two parents. We can help you attempt to reach a reasonable
agreement with your co-parent through direct negotiation with that parent (or his or her attorney if one has been
retained), or through the process of mediation if an impartial third party is needed. If negotiation is not possible
or is not successful, we can present your preferences, and all the reasons that those preferences would be in the
best interest of your child, to the court, and ask the court to make that decision in the form of an order.
At the Law Office of Rachel Li, our focus will be on
representing you and advocating for the arrangements you want; at the same time, however, we will be asking you
to always consider what is in the best interest of your child and to seek that outcome. If we can persuade the
court that your preferences are also those that are in the best interest of your child, it is much more likely
that the court will accept the arrangements we propose on your behalf.
